FresherUp's Commitment to Protecting Your Personal Information

FresherUp's primary objective is to optimize the process for organizations and candidates (those with less than two years of experience) to find suitable matches for job vacancies and employment opportunities. We believe it is paramount that you understand how your information is collected, utilized, and protected, and how you can manage it when interacting with us. This Privacy Policy elaborates on all these aspects.

By registering and creating an account with us, using our products and services, accessing our platform, or simply interacting with us (via phone, email, in person, or any other means), you agree to the terms stipulated in this Privacy Policy.

1. Personal Information FresherUp Collects

1.1. Registered Users

When you register or use FresherUp's services, we collect your Personal Information. Personal Information refers to any information that can directly or indirectly identify a specific individual.

  • To register and become a Registered User on our platform (whether you are a Candidate or an Employer), you will need to provide basic information such as your name and email address;
  • If you are a Candidate and choose to create a Profile or apply for a job, we will need to collect necessary Personal Information.

Categories of Personal Information

Description
General Data

For Registered Users (Candidates and Employers), we will collect your name, email address, and password.

For Candidates creating a Profile, we collect personal information such as date of birth, personal image, residential address, and language proficiency.

For Candidates applying for a job:

  • Resume;
  • Personal objectives, work experience, educational qualifications, professional qualifications, language skills, and other skills;
    If you choose to add references to your profile, we will request their name, phone number, email, and job title. This information will be attached to your job application, allowing employers to contact them for references.

For Employers, we collect information related to your business, including:

  • Business name, logo, address, and phone number;
  • Business sector and industry;
  • Official website and social media channels;
  • Tax identification number and business license.

We collect the application status of candidates with Employers (including statuses such as shortlisted, invited for interview, rejected, or equivalent statuses) to provide information to candidates.

Information marked "Required" is data you must provide and consent to FresherUp processing. If you do not provide or do not consent to our processing of this information in accordance with the Privacy Policy, we will be unable to provide services to you, and your registration will be declined.

Contact Data

For Candidates, we collect email addresses, mobile phone numbers, other contact numbers, and home addresses.

For Employers, we collect the name, email address, and phone number of the primary contact person (the Employer account manager).

Any other contact data you choose to share with us will also be collected.

Usage and Device Data

When you access and use the FresherUp platform, we automatically collect the following information:

  • Platform activity information: This includes the pages you have visited, your search and click history, and how you interact with personalized content on the platform.
  • Device and technical information: We collect your IP address, browser type and version, the page you visited before ours (referrer page), operating system, access timestamps (date and time), along with clickstream data stored in log files.
  • Device ID and Cookies: We also collect your device ID and use Cookies (small files placed on your browser or device) to automatically gather this data.
Third-Party Information

You may provide us with the following third-party information: Name, email address, mobile phone number, other contact numbers, workplace, and job title. This also includes their relationship to you, as a Registered User.

Please ensure that you have obtained the consent of the relevant third party before providing any of their Personal Information to us.

Location Data We collect your home address, contact address, and/or device location when you use the platform on a mobile device. However, your device's location is stored only on the device itself and only when you have granted the platform permission to access your location information.


1.2. For Unregistered Users

If you interact with us without having registered an account (e.g., contacting us via phone, email, or message), we may collect the following types of data:

  • Usage and Device Data: Information about how you interact with our platform and details about the device you use;
  • Contact Data: Information you provide so we can communicate with you (if you participate in our surveys);
  • Location Data: Information about your location, if collectible via your device and you have granted permission.

1.3. Other Types of Information

In addition to the types of information already mentioned, we may also collect other Personal Information that you actively provide during your interactions with us, such as when you participate in FresherUp surveys.

2. FresherUp's Policy on Collecting Sensitive Information

In most cases, we do not request or collect your Sensitive Information. You should not disclose any unnecessary or irrelevant Sensitive Information when using FresherUp's services. Candidates should be particularly mindful of this during the job application process.

However, in certain specific circumstances, we may need to collect and process your Sensitive Information. For example, some candidates may choose to provide specific health information (such as vaccination status) to Employers when completing job applications. In such instances, we will collect that information on behalf of the Employer.

We will only collect Sensitive Information when:

  • You voluntarily consent to our collection and processing of such information by including it in documents you provide to Employers during the application process, or when you voluntarily include it in your Profile;
  • There is another legal basis that permits us to collect Sensitive Information.

3. FresherUp's Purpose for Collecting Personal Information

3.1. Providing Products and Services to Users

Delivering Products and Services

We use your information to deliver our products and services, including but not limited to:

  • Supporting and enabling Candidates to search for and apply for jobs.
  • Assisting Advertisers in recruiting for positions;
  • Processing your transactions;
  • Verifying you as a Registered User, including through the use of artificial intelligence and machine learning tools.

Customizing and Improving Products and Services

We use your information to customize and enhance the quality of FresherUp's products and services.

Your information may be integrated into our artificial intelligence (AI) and machine learning (ML) systems to tailor features and personalize your experience. This includes, but is not limited to, the following activities:

  • Providing Accessibility Signals: We provide accessible signals to Employers, indicating a Candidate's potential suitability for a specific job opportunity.
  • Assessing Candidate Suitability: We use candidate resumes created on the platform (along with other factors) to evaluate a Candidate's suitability compared to other Candidates for potential job opportunities. During this process, Candidate resumes may be automatically processed by AI and ML systems, requiring the use of Personal Information, to classify a Candidate's potential suitability during the Employer's assessment for a specific job posting.

Communicating with You and Providing Technical Support

We may contact you and provide information related to your use of the FresherUp platform, our products, or services, as well as offer technical support and other forms of assistance. When we speak with you by phone, calls may be recorded for training purposes, information verification, and service quality assurance. Additionally, we may send SMS messages to Registered Users to verify identity and enhance their account security.

3.2. Marketing and Communication Purposes

Marketing and Promoting Our Products and Services

We use your information to send you marketing and promotional materials for direct marketing purposes. These materials may include:

  • Information about our new products and features.
  • Recruitment information and career-related content.
  • Newsletters, survey requests, and information about events we believe may be of interest to you.
  • We may contact you through various channels, including but not limited to: email, SMS messages, online platforms, phone, and social media.

Usage and Device Data

We track and monitor your Usage and Device Data to personalize, manage, and target the display advertisements you may see.

Surveys and Research for Product Quality Enhancement

We use your information to conduct market surveys, product testing, and customer research. The purpose is to better understand your needs, thereby improving and developing new products and services to deliver the best experience and meet your expectations.

3.3. Compliance with Legal and Regulatory Obligations

We process your Personal Information to comply with applicable legal obligations, compliance requirements, and regulations. Specifically, this includes addressing requests related to your rights concerning the use and processing of your personal data. Furthermore, we also use this information to respond to potential information requests from relevant regulatory or law enforcement authorities.

4. How FresherUp Collects Your Personal Information

4.1. Directly from You

We collect Personal Information directly from you when you:

  • Register and create an account with us.
  • Use any of our products and services (including when you communicate with us).
  • Or simply access our Platform.

4.2. Indirectly (from Third Parties)

We collect information indirectly in the following ways:

  • When we work with third parties: For example, from our Service Providers and Partners (including recruitment software providers);
  • From Employers (for Candidates): If you are a Candidate, we may collect additional Personal Information about you through Employers if this information is recorded on our Platform during the job application process;
  • From government and law enforcement agencies: We may also collect your Personal Information from government agencies, law enforcement agencies, and regulatory bodies when necessary and required. This may include, but is not limited to, police, immigration authorities, customs, and border security.

4.3. From Your Online Activities

We use Cookies to collect your Usage and Device Data when you use FresherUp and when you interact with our advertisements on third-party websites. For more information about Cookies and Usage and Device Data, please refer to Section 11 below.

5. What Happens if You Don't Provide Personal Information to FresherUp?

Processing your Personal Information is essential for us to provide our products and services to you. If you do not wish for your information to be processed for the purposes outlined in this Privacy Policy, you may need to stop using our platform, products, or services, or cease interacting with us.

You have the right to choose not to share your Personal Information with us. However, please be aware that if you do not provide necessary Personal Information, we may be unable to provide some or all of our products or services to you.

Furthermore, we also require your Personal Information to fulfill our legal obligations. If the processing of your Personal Information is based on the legal ground of compliance with these obligations, your failure to provide us with certain Personal Information could result in us and/or you breaching those legal obligations.

6. Your Rights Regarding Your Data

6.1. Overview

You have the right to make certain requests regarding the Personal Information FresherUp holds about you. Some of these rights apply only in specific circumstances as detailed below.

Accessing Information

You have the right to ascertain whether we hold Personal Information about you and to request access to that information.

  • For Candidates, you can access your information at any time by logging into your account and navigating to the "Manage Account" section and Profile page.
  • For Employers, you can access your information at any time by logging into your account and accessing the "Manage Account" and "Organizational Profile" sections.
  • Additionally, any User may contact us to request access to their Personal Information.

Correcting Information

You have the right to request the rectification of any inaccurate or incomplete Personal Information we hold about you.

  • For Candidates (excluding those who have only registered an account and do not have a Profile), you can change or update your Profile at any time by logging into your account, accessing the "Manage Account" section and Profile page.
  • For Employers, you can access your information at any time by logging into your account and accessing the "Manage Account" and "Organizational Profile" sections.
  • Additionally, any User may contact us to request the rectification or update of their Personal Information.

Deleting Information

For Candidates, you can request us to delete your Personal Information held in your account by logging into your account and accessing the "Manage Account" section, or by choosing to delete the Personal Information accessible on your Profile page.

Furthermore, any User may contact us to request that we restrict the Processing or delete their Personal Information, or withdraw their consent to our Processing of such Personal Information. When you contact us directly with a request under this section, we may ask you to provide information to verify your identity before proceeding with the request. Depending on the specific circumstances and the provisions of applicable Privacy Laws, we may not be able to fulfill all your requests. In cases where a specific request cannot be fulfilled, we will inform you.

You can request account deletion by sending an email to FresherUp at hi@fresherup.com requesting assistance with the subject "Account Deletion Request". We will review and respond.

You may also contact us to request access to any additional Personal Information rights you may be entitled to under applicable Privacy Laws. We will respond to your request as soon as possible and in accordance with legal requirements.

You are responsible for providing us with accurate, complete, and up-to-date information about yourself and any other individuals for whom you provide us with Personal Information, and for updating this information when it becomes inaccurate or outdated. For Candidates, we reserve the right to deactivate and/or delete your Profile or certain information contained within it (including stored resumes or cover letters) at our sole discretion. We may take these steps if, for example, the information is found or believed to be untruthful or stored for inappropriate purposes.

In addition to the rights stipulated in this section, you have all the rights of Data Subjects as specified in Article 9 and Article 12 of Decree 13/2023/ND-CP on Personal Data Protection.

6.2. Displaying Candidate Profiles

Once a Candidate successfully creates a job profile, you have the right to choose whether to make your Profile public or private to employers. Candidates will set this visibility preference in the "Settings" section once the profile is successfully created under "My Application". Candidates who don't yet have a Profile will also be prompted to create one when they first apply for a job on our Platform. A Profile can include a resume, work and educational experience, contact information, licenses, certifications, skills, languages, and personal objectives.

Regardless of the visibility settings you've chosen when creating your Profile, by applying for a job posting, your Profile will be shared with the relevant Employer. Candidates can modify their Profile before submitting an application to an Employer.

6.3. Sharing Profiles

You can share a version of your Profile via a shareable link (referred to as a Shared Profile). Once your Profile is successfully created, and within the "Settings" section, Candidates can generate this link, then copy and share it to their Profile.

When you share the link to your Shared Profile, you agree that anyone with that link:

  • Will be able to view the information from your Profile as listed above.
  • Will be able to re-share and reuse that link.

You can TURN OFF the ability for people to access your Shared Profile at any time in your Profile visibility settings. However, while your Profile sharing feature is ON, those who already have the link will still be able to view and share information about you as stated. Although your Shared Profile can be viewed by anyone with the link, it cannot be publicly searched.

7. Parties FresherUp Shares Your Personal Information

7.1. Employers

If you are a Candidate, you agree that we may share your Personal Information with Employers when you apply for a job on our FresherUp platform. Regardless of the Profile visibility settings you have chosen when creating your Profile (as described in Section 6.2), when necessary, certain parts of your Profile (which may include General Information, Contact Information, Third-Party Information, and Location Information) will be shared with Employers.

When you submit an application, you agree that the information in your Profile and job application may be shared with the relevant Employer and stored in:

  • Our recruitment center (on behalf of the Employer).
  • The Employer's applicant tracking system.

We are not responsible for and cannot guarantee the security of your Personal Information when it is stored by Employers outside of our Platform. Any questions you have regarding jobs advertised by us, your job application, and/or your application status should be directed to the Employer.

Please note that if you choose to share your Profile, resume, or any other application information with Employers, these Employers may intentionally or unintentionally share this information with other parties (for example, when you apply for a job posting by an intermediary recruiter, who then shares your information with the official employer of the job). The use or sharing of your information (personal or otherwise) by these Employers and the storage of your information in Employer systems outside of our Platform are beyond our control. We cannot be held responsible for their actions or the security of their systems. However, we require Employers to comply with all applicable laws, including obligations related to the use and disclosure of Personal Information outlined in applicable Privacy Laws and any other relevant laws, including those governing health information.

Candidates should contact Employers directly to request access to or deletion of any Personal Information they have provided when applying for a job or by making their Profile public on the platform.

7.2. Third Parties

Service Providers and Partners

We may share your Personal Information with third parties, such as our Service Providers, contractors, and Partners, from time to time. This sharing is solely for the following purposes:

  • To assist us in providing our products and services to you.
  • To enable your access to products or services they offer.
  • To conduct surveys, testing, and customer research.
  • Or for any other purpose outlined in Section 3 of this Privacy Policy.

Government Authorities

We may share your Personal Information with relevant government agencies, law enforcement authorities, regulatory bodies, or authorized officials who have the legal authority to request the disclosure of Personal Information. This includes any obligations to comply with court orders or other legal obligations we may have.


Mergers, Acquisitions, or Reorganizations

In the event of any merger, acquisition, or reorganization, we may share your Personal Information with the acquiring party or any potential buyer of any business.

7.3. Links to Third-Party Websites

On the FresherUp platform, we may provide links to other websites or mobile applications not owned or controlled by us (referred to as Third-Party Websites). We are not responsible for the privacy practices of such websites. Users are advised to carefully review the privacy policies of Third-Party Websites before using them.

8. When FresherUp Transfers Your Personal Information Internationally

We may share your Personal Information outside of your home location in the following circumstances:

  • With Overseas Service Providers, Partners, and Third Parties: We may share your Personal Information with Service Providers, Partners, or other third parties who are providing services to us from overseas locations;
  • With International Employers: When your Personal Information is shared with Employers located outside your usual place of residence. Overseas Employers may access your Personal Information through job applications;
  • To Comply with Legal Obligations: When we deem sharing necessary to comply with any legal or regulatory obligations.

9. How FresherUp Secures Your Personal Information

We implement reasonable measures to ensure the security of our systems and protect your Personal Information from risks such as misuse, interference, loss, as well as unauthorized access, modification, or disclosure. All Personal Information we hold is stored on secure servers and safeguarded within controlled facilities.

We adhere to accepted industry standards to protect your Personal Information. However, please remember that no method of data transmission over the internet or electronic storage is entirely secure.

We require third parties with whom we share your Personal Information (including Employers) to comply with all relevant obligations regarding the use and disclosure of Personal Information under applicable Privacy Laws and any other relevant laws. When you are asked by a third party to provide information directly to them (e.g., when you apply for a job through an Employer's recruitment platform), their use of your information will be governed by their own privacy policy, and this is not our responsibility or within our control.

You also play a crucial role in protecting your personal information by maintaining the confidentiality of any passwords and accounts used on the Platform. Please notify us immediately if you discover any unauthorized use or security breaches related to your account.

10. FresherUp's Personal Information Retention Period

We will retain your Personal Information for the period necessary to fulfill the purposes for which it was collected and processed under this Privacy Policy. We will also retain the information until you request us to delete it. Upon receiving your request, we will take reasonable steps to delete that Personal Information, if required by applicable Privacy Laws.

If you have applied for jobs on our Platform and consequently provided your Personal Information to Employers, you will need to contact those Employers directly to request the deletion of your information from their systems.

We may continue to retain your Personal Information even after you have requested its deletion if retention is reasonably necessary for us to:

  • Comply with our legitimate interests, legal, and regulatory obligations.
  • Resolve disputes between Users.
  • Prevent and remedy any fraudulent and/or abusive conduct.
  • Store in testing or backup systems (for a specific period).
  • Or to enforce this Privacy Policy and/or any of our other Terms and Conditions.

When information is retained in a testing environment, it will be in a closed and secure environment, used solely for internal software testing purposes. Information retained in backup systems is kept only for the purpose of system recovery in the event of data loss.

11. How We Use Cookies and Usage and Device Data

11.1. IP Address

Our web servers automatically collect your Internet Protocol (IP) address. The purpose of this is to aid in diagnosing and resolving issues related to our services, as well as to monitor Platform usage, including identifying the general location of Users.

11.2. Cookies and Similar Technologies

We use Cookies to give Users a better Browse experience. These Cookies collect detailed information like your preferences and click activity. This information is used to:

  • Enhance website performance: Analyze, develop, and test our new services and functionalities.
  • Support business operations: Inform business decisions, aid in error reporting, support online payments, and provide reports to advertisers and business Partners about results achieved through our services. This information may be received from or shared with any of our Service Providers and Partners, for the purpose of providing you with improved products and services.

We also use Cookies and similar technologies (e.g., Device IDs) to customize display advertisements from our Partners and Employers. These advertisements appear on FresherUp or other third-party websites and applications (referred to as Ad Placements). This customization is based on your interests, actions, and behavior on those Ad Placements (which may be collected through the use of Cookies), your Profile, and/or information provided as a user on the Ad Placements. Display advertisements can target Candidates, Employers, or other types of visitors to those Ad Placements.

We also collect and use Device IDs to identify you and your device across, beyond, and on different services and devices you've interacted with our products and services. To do this, we share your Device IDs with our Partners and Service Providers.

Our Partners and Service Providers may place Cookies on certain pages that Users visit on FresherUp. These Cookies are designed to collect non-personal information to analyze User preferences and searches on our Platform. The purpose is to help deliver more relevant display advertising when Users visit our Platform and other websites. The non-personal information collected by these Cookies may be shared with other third parties for the purpose of managing, targeting display advertising, and market research analysis.

11.3. How to Control Cookies and Display Advertising

You can restrict the use of your information for targeted display advertising by updating your browser settings to block Cookies or by updating the display advertising settings in your mobile device's system settings.

If you do not want Cookies to operate when Browse our Platform, you can "opt-out" by modifying the privacy options in your browser. However, doing so will prevent access to certain areas of the Platform and limit your use of some of our products and services.

11.4. Third-Party Measurement

To better understand our Users, we utilize third-party Service Providers to measure and evaluate FresherUp's traffic. Cookies are employed to gather the following information about the use of our Platform:

  • The number of page views (or page impressions) occurring on the Platform.
  • The number of unique visitors to the Platform.
  • The average time these unique visitors spend on the Platform during their visits.

For Unregistered Users of our Platform, this aggregated information is collected and provided to us to assist in analyzing Platform usage. For Registered Users, this information is linked across different sessions on various devices to our Platform to provide a more accurate total user count before aggregation. This data may also be accessed by media organizations and research companies for the purpose of conducting industry comparisons with other organizations.

12. Children's Privacy

We do not knowingly collect or solicit any information from anyone under the age of 16, nor do we knowingly permit such persons to register for our Services. Our Services and content are not directed at children under 16.

In the event that we discover we have collected Personal Data from a child under 16 without parental or guardian consent, we will delete that information as quickly as possible.

If you have reason to believe that we may be holding information from or about a child under 16, please contact us immediately for assistance.

13. Updates to FresherUp's Privacy Policy

We may modify this Privacy Policy at any time. To ensure you are always informed about how we handle personal information, we recommend reviewing this Privacy Policy periodically.

In certain circumstances, depending on the nature of the changes, we will notify you of modifications to this Privacy Policy before they take effect, if required by applicable Privacy Laws.

By continuing to use our Platform, products, or services, you agree to any amendments made to this Privacy Policy.

15. Language

This Privacy Policy may be translated into Vietnamese. In the event of any conflict between the English and Vietnamese versions of this Privacy Policy, the English version shall prevail. The Vietnamese version shall be deemed automatically adjusted to ensure compliance and consistency with the English version.
