FresherUp's primary objective is to optimize the process for organizations and candidates (those with less than two years of experience) to find suitable matches for job vacancies and employment opportunities. We believe it is paramount that you understand how your information is collected, utilized, and protected, and how you can manage it when interacting with us. This Privacy Policy elaborates on all these aspects.
By registering and creating an account with us, using our products and services, accessing our platform, or simply interacting with us (via phone, email, in person, or any other means), you agree to the terms stipulated in this Privacy Policy.

You have the right to ascertain whether we hold Personal Information about you and to request access to that information.

You have the right to request the rectification of any inaccurate or incomplete Personal Information we hold about you.
Deleting Information
For Candidates, you can request us to delete your Personal Information held in your account by logging into your account and accessing the "Manage Account" section, or by choosing to delete the Personal Information accessible on your Profile page.
Furthermore, any User may contact us to request that we restrict the Processing or delete their Personal Information, or withdraw their consent to our Processing of such Personal Information. When you contact us directly with a request under this section, we may ask you to provide information to verify your identity before proceeding with the request. Depending on the specific circumstances and the provisions of applicable Privacy Laws, we may not be able to fulfill all your requests. In cases where a specific request cannot be fulfilled, we will inform you.
You can request account deletion by sending an email to FresherUp at hi@fresherup.com requesting assistance with the subject "Account Deletion Request". We will review and respond.
You may also contact us to request access to any additional Personal Information rights you may be entitled to under applicable Privacy Laws. We will respond to your request as soon as possible and in accordance with legal requirements.
You are responsible for providing us with accurate, complete, and up-to-date information about yourself and any other individuals for whom you provide us with Personal Information, and for updating this information when it becomes inaccurate or outdated. For Candidates, we reserve the right to deactivate and/or delete your Profile or certain information contained within it (including stored resumes or cover letters) at our sole discretion. We may take these steps if, for example, the information is found or believed to be untruthful or stored for inappropriate purposes.
In addition to the rights stipulated in this section, you have all the rights of Data Subjects as specified in Article 9 and Article 12 of Decree 13/2023/ND-CP on Personal Data Protection.
Once a Candidate successfully creates a job profile, you have the right to choose whether to make your Profile public or private to employers. Candidates will set this visibility preference in the "Settings" section once the profile is successfully created under "My Application". Candidates who don't yet have a Profile will also be prompted to create one when they first apply for a job on our Platform. A Profile can include a resume, work and educational experience, contact information, licenses, certifications, skills, languages, and personal objectives.
Regardless of the visibility settings you've chosen when creating your Profile, by applying for a job posting, your Profile will be shared with the relevant Employer. Candidates can modify their Profile before submitting an application to an Employer.
You can share a version of your Profile via a shareable link (referred to as a Shared Profile). Once your Profile is successfully created, and within the "Settings" section, Candidates can generate this link, then copy and share it to their Profile.
When you share the link to your Shared Profile, you agree that anyone with that link:
You can TURN OFF the ability for people to access your Shared Profile at any time in your Profile visibility settings. However, while your Profile sharing feature is ON, those who already have the link will still be able to view and share information about you as stated. Although your Shared Profile can be viewed by anyone with the link, it cannot be publicly searched.
If you are a Candidate, you agree that we may share your Personal Information with Employers when you apply for a job on our FresherUp platform. Regardless of the Profile visibility settings you have chosen when creating your Profile (as described in Section 6.2), when necessary, certain parts of your Profile (which may include General Information, Contact Information, Third-Party Information, and Location Information) will be shared with Employers.

We are not responsible for and cannot guarantee the security of your Personal Information when it is stored by Employers outside of our Platform. Any questions you have regarding jobs advertised by us, your job application, and/or your application status should be directed to the Employer.
Please note that if you choose to share your Profile, resume, or any other application information with Employers, these Employers may intentionally or unintentionally share this information with other parties (for example, when you apply for a job posting by an intermediary recruiter, who then shares your information with the official employer of the job). The use or sharing of your information (personal or otherwise) by these Employers and the storage of your information in Employer systems outside of our Platform are beyond our control. We cannot be held responsible for their actions or the security of their systems. However, we require Employers to comply with all applicable laws, including obligations related to the use and disclosure of Personal Information outlined in applicable Privacy Laws and any other relevant laws, including those governing health information.
Candidates should contact Employers directly to request access to or deletion of any Personal Information they have provided when applying for a job or by making their Profile public on the platform.
Service Providers and Partners
We may share your Personal Information with third parties, such as our Service Providers, contractors, and Partners, from time to time. This sharing is solely for the following purposes:
Government Authorities
We may share your Personal Information with relevant government agencies, law enforcement authorities, regulatory bodies, or authorized officials who have the legal authority to request the disclosure of Personal Information. This includes any obligations to comply with court orders or other legal obligations we may have.

When you are asked by a third party to provide information directly to them (e.g., when you apply for a job through an Employer's recruitment platform), their use of your information will be governed by their own privacy policy, and this is not our responsibility or within our control.
You also play a crucial role in protecting your personal information by maintaining the confidentiality of any passwords and accounts used on the Platform. Please notify us immediately if you discover any unauthorized use or security breaches related to your account.
We will retain your Personal Information for the period necessary to fulfill the purposes for which it was collected and processed under this Privacy Policy. We will also retain the information until you request us to delete it. Upon receiving your request, we will take reasonable steps to delete that Personal Information, if required by applicable Privacy Laws.
If you have applied for jobs on our Platform and consequently provided your Personal Information to Employers, you will need to contact those Employers directly to request the deletion of your information from their systems.

Our Partners and Service Providers may place Cookies on certain pages that Users visit on FresherUp. These Cookies are designed to collect non-personal information to analyze User preferences and searches on our Platform. The purpose is to help deliver more relevant display advertising when Users visit our Platform and other websites. The non-personal information collected by these Cookies may be shared with other third parties for the purpose of managing, targeting display advertising, and market research analysis.
You can restrict the use of your information for targeted display advertising by updating your browser settings to block Cookies or by updating the display advertising settings in your mobile device's system settings.

For Unregistered Users of our Platform, this aggregated information is collected and provided to us to assist in analyzing Platform usage. For Registered Users, this information is linked across different sessions on various devices to our Platform to provide a more accurate total user count before aggregation. We do not knowingly collect or solicit any information from anyone under the age of 16, nor do we knowingly permit such persons to register for our Services. Our Services and content are not directed at children under 16.
